Should the Sri Lankan Jury System be abolished?
In Sri Lanka we can see a Jury system operating in the High Court. The jury system consists seven persons. The special fact about it is,those people who are engaging for the jury are normal people. They can be selected in rural or urban areas. If anyone likes to present as a member of the jury he or she can ask about it from the high court and then to be registered. In Sri Lanka the jury system only appears for criminal cases.Such as murders, rape cases and attempting to murder.
If a guilty person ask for a jury system, then the high court called seven members of the jury and join them to the case.
We got this jury system from England. When the British people ruled our country, they met a problem in solving cases in the court. The problem was the judges couldn't understand the situation of the guilty person.Because they didn't know about that person's family and social background and also there were some language issues. So,those matters made judges more difficult to get the right decissions. That's how we have given the jury system and after decades passed we still work with it.
According to my opinion the jury system should continue.Because using a jury system is a one sign of proving good democracy and better human rights.Another one is,sometimes we can see some judges are very mechanical and they act like robots.I don't say we must be emotional on legal things. But the law means to do the justice. So,to the best of my knowledge I think using a jury system in the court is very good thing and it shows the justice.
When it comes to the progress of the jury system, the seven members participate to the case and discussed about the case using all evidence they had listen and seen. Then they decide the person is guilty or not guilty. The judges accept their decision. That is how a jury system work in the high court.Always the using of a jury system is better to gain the justice for people. So,the jury system should be continued for the betterment of mankind.
